1. Agreement to Terms
By accessing or using the services provided by Creative Studio ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
2. Services
Creative Studio provides web development, design, and related digital services. The specific scope, deliverables, timeline, and pricing for each project will be outlined in a separate project proposal or contract.
3. Payment Terms
- A deposit of 50% is required before work commences on any project.
- The remaining balance is due upon project completion, before final files are delivered.
- Invoices are payable within 14 days of issue unless otherwise agreed in writing.
- Late payments may incur additional fees.
4. Intellectual Property
Upon full payment, the client receives ownership of the final deliverables specifically created for their project. Creative Studio retains the right to use work samples in our portfolio unless otherwise agreed. Third-party assets (stock images, fonts, plugins) remain subject to their respective licenses.
5. Client Responsibilities
Clients are responsible for:
- Providing accurate and timely content, feedback, and approvals.
- Ensuring they have the rights to any materials provided to us.
- Maintaining backups of their own data.
- Keeping login credentials secure.
6. Revisions & Changes
Project proposals include a specified number of revision rounds. Additional revisions or scope changes may incur extra charges, which will be communicated and agreed upon before work proceeds.
7. Warranties & Disclaimers
We warrant that our work will be performed professionally and to industry standards. However, we do not guarantee specific results such as search engine rankings, traffic, or revenue increases. Our services are provided "as is" without warranties of merchantability or fitness for a particular purpose beyond what is explicitly stated.
8. Limitation of Liability
Creative Studio's total liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific project in question. We are not liable for indirect, incidental, or consequential damages.
9. Termination
Either party may terminate a project with written notice. Upon termination, the client is responsible for payment of all work completed up to the termination date. Deposits are non-refundable once work has commenced.
10. Governing Law
These terms are governed by the laws of South Africa. Any disputes will be resolved in the courts of South Africa.
11. Changes to Terms
We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated revision date.
